Sen. Joey Hensley Highlights Drug-Related Legislation Passed in 2026 Session

State Sen. Joey Hensley is highlighting several measures approved during the 2026 legislative session aimed at combating drug abuse and strengthening enforcement of Tennessee’s controlled substance laws.

Among the measures is a new law banning the sale and distribution of kratom in Tennessee. The legislation makes possession a misdemeanor and the sale or distribution of kratom a felony, with enhanced penalties for offenses involving minors. The law also requires kratom testing in overdose investigations.

Lawmakers also approved legislation strengthening regulations on vaping products. The measure expands restrictions on youth access, clarifies that liquid nicotine products are covered under state law, and shifts enforcement authority to the Tennessee Alcoholic Beverage Commission.

Another bill ensures that any future changes to Tennessee’s marijuana laws must be approved by the General Assembly, regardless of any federal reclassification of marijuana.

The legislature also increased penalties for people under 21 who unlawfully purchase or possess tobacco, vaping, or other nicotine products. First-time offenders may be ordered to complete community service or a court-approved program, while repeat offenders may face probation.

In addition, lawmakers approved legislation targeting the misuse of nitrous oxide. The new law creates a Class E felony for the retail sale of nitrous oxide intended for recreational intoxication and establishes civil penalties ranging from $2,500 to $5,000, with possible revocation of retail licenses for violations.

Hensley said the legislation is part of a broader effort to make Tennessee a better place to live, work, and raise a family.
