Brian Lansing Martin Waives Mental Competency Hearing, Could Face Trial in Early 2026

Attorneys for Brian Lansing Martin are now informing the Colbert County trial judge that he is waiving his right to a mental competency hearing, potentially clearing the way for a trial in early 2026, according to WHNT. Martin is accused of killing his roommate, William Mealback Jr., and pushing him out of a truck in Muscle Shoals in October 2021, which led to a police chase and shootout that left Sheffield Police Sergeant Nick Risner dead and another officer injured. On Monday, Martin’s attorneys filed a motion to withdraw their request for a competency hearing. The court has not yet ruled on the motion. If granted, the next step would be scheduling a trial. Questions about Martin’s mental health have been central to the case and have contributed to multiple delays in his capital murder trial. In November 2023, the Alabama Department of Mental Health initially found Martin was not competent, then later said additional evaluation was needed. After waiting more than a year for a subsequent evaluation, the defense filed an objection to its findings. Martin’s attorneys had originally requested the competency hearing and a third-party evaluation following the department’s assessment. The hearing had been scheduled for January 2026, during which a jury would determine whether Martin understood the case against him and could assist in his defense. Prosecutors have said they intend to seek the death penalty against Martin.
