The Madison County District Attorney’s Office has concluded its investigation into injuries sustained by a Deshler High School football player, calling the incident a “freak accident” and confirming that no criminal charges will be filed, according to WAAY 31. The update regarding August Borden’s case was provided during a Wednesday press conference. The DA’s office reported that the incident involved typical high school interactions and limited physical contact, with no evidence of malice or reckless behavior. August suffered a severe skull fracture and concussion at the school on August 19, resulting in hospitalization. His parents previously challenged claims from school officials that the injuries were caused by a fall, noting that August cannot recall the incident due to the severity of his injuries. The Madison County DA’s Office took over the investigation from Colbert County because of a potential conflict of interest. Deshler High is located in Colbert County. Officials previously said that if charges were filed, they would be handled through Franklin County’s juvenile probation office and Lawrence County District Court. That is no longer relevant, as no criminal charges will be pursued.
