Hensley Reviews Election-Related Laws from 2025 Session

The 114th General Assembly adjourned earlier this year after passing several measures that affect Tennessee’s election system. Lawmakers approved a new law requiring primary elections to remain the standard method for political party nominations in local races. Counties that currently use caucuses may continue to do so, but those with primaries must keep them in place. Senator Joey Hensley opposed the measure, arguing counties should decide their own procedures. The budget includes $8 million to fund the 2026 primaries. Another new law directs election coordinators to train local officials on recognizing temporary IDs issued to non-citizens, part of an effort to prevent non-citizen voting. It follows legislation passed in a special session that set up a system for temporary licenses and permits for non-citizens living in Tennessee. Voter eligibility verification was also strengthened. Citizenship status and felony records will now be checked before registration is approved. The Coordinator of Elections, Department of Safety, and TBI will create a secure portal to confirm eligibility in real time. School board elections will now align with county legislative body elections, adopting the same staggered terms and limits as county commissioners. Lawmakers also approved changes to the voting rights restoration process for those with felony convictions. The new system streamlines suffrage restoration without requiring a full pardon, though eligibility requirements remain in place, including repayment of restitution, court costs, and child support. Individuals with multiple felony convictions must complete the process separately for each offense, while those convicted of the most serious crimes — including murder, aggravated rape, treason, and voter fraud — remain permanently barred from voting.
